FAQ

Whether machinery is subject to the new rules often depends on when it is placed on the market, not when the contract is signed. Projects ordered in 2026 and delivered in 2027 need a compliance path defined in advance.

Regulation (EU) 2023/1230 will apply from January 20, 2027, replacing the current Machinery Directive. It covers machinery, interchangeable equipment, safety components, lifting accessories, and partly completed machinery, among other products. For long-lead-time equipment requiring on-site integration or software control, buyers should not wait until shipment to confirm the technical documentation.

Why does the new regulation affect procurement contracts?

Equipment may cross the transition date

A customized production line may take more than a year from design to installation. A quotation may be based on the old directive, while the equipment may need to comply with the new regulation when placed on the market. The contract should specify the relevant date, applicable legislation, and who bears the cost of reassessment.

Software and cyber risks enter the safety discussion

Modern machinery relies on PLCs, remote maintenance, and safety software. Unauthorized access or software changes can affect safety functions, so buyers need to test cybersecurity and machinery safety together.

Substantial modifications may change the responsible party

If a buyer or system integrator changes speed, guarding, control logic, or intended use on site, the change may qualify as a substantial modification and trigger new manufacturer obligations. The supplier's original CE documentation cannot automatically cover every modification.

The right sequence from RFQ to acceptance

Define the intended use before the RFQ

Buyers should specify materials, speed, operators, environment, loading and unloading methods, and interfaces with other equipment. Without a clear intended use, the supplier cannot complete a reliable risk assessment.

Fix the responsibility matrix in the contract

Separate the duties of the manufacturer, importer, system integrator, and end user: who assesses the complete line, provides translations, retains documents, and approves software changes.

Test FAT and SAT separately

The Factory Acceptance Test (FAT) verifies the machine itself. The Site Acceptance Test (SAT) verifies installation, interlocks, guards, emergency stops, and interfaces with other equipment. Neither test replaces the other.

Scope and limitations

Machinery classification, the placing-on-the-market date, substantial modifications, and conformity-assessment procedures must be assessed project by project. Some machinery may also be subject to pressure-equipment, ATEX, electromagnetic-compatibility, radio, or cybersecurity rules. This article does not replace notified-body or legal advice.

FAQ

Does a CE mark mean buyers do not need to review technical documentation?

No. The CE mark is the outcome. Buyers should still confirm that the declaration, instructions, risk controls, and product version are consistent.

Can changing a PLC program on site create compliance risk?

Possibly. If the change affects safety functions, performance, or intended use, it should be reassessed to determine whether it constitutes a substantial modification.

What should buyers do first?

Identify equipment projects expected to be delivered or placed on the market after January 20, 2027, and confirm the applicable rules and responsible party for each one.

Machinery compliance is not merely a stack of documents delivered with the equipment. It is a continuous chain of responsibility from intended-use definition through design, integration, and on-site modification.

What buyers truly need to accept is not only whether the machine can run, but whether it can continue to be used safely and legally in its intended environment.
